Every person who wants to become a professional LVN or RN nurse in the state of Texas needs to go through several processes. First of all, there is a need to complete tertiary education in a nursing school. After graduation, the next step is to take the nursing board examination. The goal is to pass the said exam in order to become part of the professional nurses in Texas. The Texas Board of Nursing (BON) is the government agency that has jurisdiction to hear and decide cases involving nursing practitioners.

In one case filed before the Board, a registered nursed Meredith was made as a respondent. There were two charges filed against her for misconduct during her employment in a state hospital. In the first charge, it was alleged that she engaged in the intemperate use of Methadone, in that the RN nurse produced a specimen for a pre-employment drug screen, which resulted positive for Methadone.

In the second charge, it was said that the nurse withdrew Morphine from the Medication Dispensing System for patients in excess of the frequency or dosage of physician’s orders. The conduct of the RN nurse was likely to injure patients, in that the administration of Morphine in excess dosage could result in the patients suffering from adverse reactions, including respiratory depression and was in violation of Chapter 481 of the Texas Health and Safety Code.

The RN nurse was given an opportunity to be heard. The Texas Board of Nursing (BON) gave him sufficient time to defend the complaints filed against him. However, there was failure on the RN nurse’s part to find the right lawyer to handle his case. The negligence of the nursing defense lawyer led the professional RN nurse to lose his license.

If you have received a letter from the Texas BON for use of drugs/alcohol or any other offense, it is best to consult an experienced Texas Nurse Defense Attorney who can guide you on the steps you need to take to protect your nursing license.
