Obtaining any Controlled Substance is a serious offense and could result in a great consequence if not dealt with properly by having an experienced and skilled nurse attorney. It was on or about December 17, 2018, the LVN entered a plea of Guilty to OBTAINING A CONTROLLED SUBSTANCE BY FRAUD, a 3’ᵈ Degree Felony offense was committed on December 31, 2016. As a result of the plea the proceedings against the LVN were deferred without entering an adjudication of Guilt, and the LVN was placed on probation for a period of ten (10) years and ordered to pay a fine and court costs

In response to the above incident, the RN states she was accused of taking 2 Tylenol #3. After speaking with her attorney, she plead guilty and accepted the probation of 10 years. In Addition, she voluntarily entered the Texas Peer Assistance Program for Nurses (TPAPN).

Therefore, the Texas Board of Nursing decided to put the LVN into disciplinary proceedings and was given the chance of legal counsel, yet failed to hire an experienced and skilled nurse attorney. The LVN had received further sanction as a consequence of her conduct, her LVN license was put into suspension until the LVN complies with the Agreed Order.
