An experienced nurse attorney has surely helped a lot of RNs and LVNs when it comes to cases that may lead to disciplinary action. Unfortunately, not all nurses were able to hire a nurse attorney as they underwent such cases. This incident that an RN committed in 2014, was one of those examples.

On or about January 1, 2012, through May 9, 2014, while employed as a Licensed Vocational Nurse in McKinney, Texas, the LVN practiced nursing on a delinquent Texas nursing license. Her conduct was likely to deceive the facility in that they relied on the license is current and in good standing while making assignments to her which included patient care.

On or about May 9, 2014, while employed in the same medical facility, the LVN administered four (4) intramuscular (IM) injections to a pediatric patient without first verifying the contents of the syringes. As a result, she administered Rotarix via IM injection instead of by oral route. Her conduct was likely to injure the patient from adverse reactions due to the vaccine being administered via the incorrect route.

The Texas Board of Nursing has full jurisdiction over all cases regarding errors committed by an RN or LVN. Thus, she was called by the Board to defend against the case.

During the hearing, the LVN states she tried to renew her license but did so too early and then forgot to do so. In regards to the Rotarix administration, she states she administered four (4) intramuscular (IM) injections. The LVN states she did not verify the contents of the syringes before administering them. The LVN states she administered an IM injection of Rotarix. She states immediately after administering the immunizations, she realized that it was an error.

The following incident and defense against the case caused the Texas Board of Nursing to place the LVN and her license into disciplinary proceedings. She would have sought assistance from a good nurse attorney to provide clarifications towards the case.
