An instance wherein a negligent behavior was charged against an LVN happened on or about November 17, 2017, when the LVN falsely documented a re-certification visit when the patient had been admitted to the hospital on November 15, 2017. Her conduct created an inaccurate medical record and was likely to injure the patient in that subsequent caregivers did not have accurate and complete information on which to base their decisions for further care.

On or about November 20, 2017, while employed in the same medical facility, the LVN falsely documented a resumption of care visit. Additionally, she signed her own name under the “Client Signature” section of the documented visit. Her conduct was deceptive and created an inaccurate medical record.

The Texas Board of Nursing summoned the LVN to a hearing to defend her side. During the hearing, the LVN states that she arrived at the patient’s home to perform her assessment. She had been previously instructed by the prior nurse who had provided care for this patient to begin visits prior to entering the home, as they must be at each patient’s home for at least thirty minutes for the visit to be billable.

When the LVN knocked on his door the day in question, she was yelled at and screamed at by someone inside the home to go away and told not to come back. The LVN states she documented the visit because she was already logged in and had started the visit. She was unsure of how to discard the visit since she was new. The LVN admits this in no way justifies my actions and I deeply regret the way she handled the situation.

The LVN states that she did not falsely document anything. This is a simple misunderstanding of her signing in the wrong spot by being in a hurry and not paying close enough attention while ending the visit and chatting with the patient while doing so.

However, she failed to properly defend her case by not hiring the perfect attorney for her case.
