The Texas Board of Nursing (BON) has the jurisdiction to hear and decide cases involving the practice of professional nursing in Texas. Any RN or LVN found guilty for violating the state laws and regulations as well as charged with a case may be subjected to a disciplinary case if not properly defended by a Fort Worth Nurse Defense Lawyer.

On or about February 10, 2018, through February 11, 2018, while employed as a Registered Nurse in Fort Worth, the RN accepted a nursing assignment providing care to ventilator dependent patients without first obtaining competency and/or experience in nursing care of ventilator dependent patients. Her conduct exposed the patients to risk of injury from lack of competent nursing care; including, respiratory distress and hypoxia.

The RN also failed to completely and accurately document administration of the acetaminophen in the Medication Administration Record of the Patient. Her conduct created an inaccurate medical record and was likely to injure the patient in that the administration of medications in excess frequency/dosage of the physician’s order could result in the patient suffering adverse reactions.

During the said date, the RN also failed to timely notify the provider for approximately two (2) hours following an acute change in condition of a patient who was exhibiting signs of respiratory distress. The RN also failed to timely escalate care when there was no response from the physician. Subsequently, the resident exhibited worsening respiratory distress for approximately an additional four (4) hours before she contacted emergency medical services. Her conduct resulted in delayed treatment and may have contributed to the resident’s demise.

The RN also failed to document a phy nursing assessment for a patient during the shift. Her conduct created an incomplete medical record and was likely to injure the in that subsequent care givers would not have accurate and complete information on which to base their care decisions.

The Texas Board of Nursing summoned the RN to hear her side of the story. During the hearing, the RN states her past employment provided her with the training necessary to care for tracheostomy and ventilator-dependent patients. She also states she contacted the nurse practitioner when the physi respond, and also states she attempted to contact her supervisor.
